By accessing the website DMSO.co.za (“the Website”) or purchasing products from DMSO.co.za (“the Company”), you (“the Customer,” “the Buyer,” or “the Reseller”) hereby agree to be bound by the following Terms of Service, Disclaimer, and Compliance Policy. If you do not agree to these terms, you must not use this website or purchase our products.

1. Product Classification and Intended Use

1.1. Industrial and Analytical Use: DMSO (Dimethyl Sulfoxide) supplied by the Company is categorized and sold strictly as an Analytical Reagent and Industrial/Laboratory Organic Solvent.
1.2. Not a Medical Product: The Customer acknowledges that the product is not sold as a medicinal substance, therapeutic treatment, or pharmaceutical-grade medicine.
1.3. Regulatory Status (South Africa): In accordance with South African law, DMSO is a Schedule 4 substance when intended for medicinal use. However, the Company operates under the legal “Safe Harbor” exemption, whereby DMSO remains exempt from such scheduling when sold for industrial, analytical, and laboratory applications. By purchasing, the Customer confirms they are using the product within these exempt categories.

2. Educational Purpose & Scientific Firewall

2.1. Educational and Informational Purposes Only: Any information, research, scientific protocols, or books accessed via DMSO.co.za (including the Website and any educational library content) are for Educational and Informational Purposes Only.
2.2. Client Acknowledgment (No Diagnosis or Treatment): By purchasing from or interacting with DMSO.co.za, all clients acknowledge that information from this Website is not intended to diagnose, treat, mitigate, or cure any disease, and does not constitute medical advice.
2.3. Scientific Reference Rule (“Scientific Firewall”): References to peer-reviewed research, historical use cases, protocols, or scientific literature are provided for educational context only and are strictly decoupled from product sales pages, “Shop” pages, checkout flows, and product descriptions.

3. Reseller & Global Compliance Standards

3.1. Branding (Industrial Terminology Only): All Resellers and international buyers must use industrial terminology only (e.g., “Organic Solvent,” “Analytical Reagent,” “99.9% Pure”) and must not present the product as a medical or therapeutic item.

    3.5. Export / Import Compliance: International buyers and resellers are responsible for ensuring compliance with the import laws, customs requirements, labeling rules, and any regulatory requirements of their specific country and destination.

4. Product Specifications and Pricing

4.1. Volume and Mass: Dimethyl Sulfoxide has a molecular mass of 78.13 g/mol. Consequently, 1 kg of DMSO is approximately equal to, but not greater than, 900 ml per kg.
4.2. Price Adjustments: All prices are subject to change without notice. Once an order is accepted by the Company, the price for that specific order is fixed.
4.3. Taxes and Duties: Stated prices do not include sales tax, VAT, use tax, excise tax, or import duties. The Buyer is responsible for all such charges unless a valid exemption certificate is provided.

5. Disclaimer & Limitation of Liability

6. Warranties and Exceptions

The Customer agrees to indemnify and hold harmless DMSO.co.za and its employees against any claims, regulatory actions (including those by SAHPRA), or legal fees arising from the Customer’s or Reseller’s failure to adhere to these compliance standards or the misuse of the product as a medicinal substance.

8. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the South African courts.
